Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Pure Souls mobile application, website, and related services (collectively, the "Service") operated by Pure Souls ("we," "us," or "our").

By registering for an account, downloading the app, or otherwise accessing the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

Pure Souls is an adults-only (18+) service. You must be at least 18 years old — or the age of majority in your jurisdiction, if that is higher — to create an account or otherwise use the Service.

There is no exception for minors. A person under 18 may not use Pure Souls under any circumstances, including with the consent or supervision of a parent or legal guardian, and including through another person’s account.

By creating an account and by using the Service, you represent and warrant that you are at least 18 years old, that the date of birth and other information you give us is true, and that you have the right, authority, and capacity to enter into these Terms.

How we enforce this

• We present an age confirmation at account creation. You must affirm that you are 18 or over before you can create an account; you cannot proceed without it.
• Members who take part in kin matching must additionally provide a date of birth and complete age verification through our identity verification provider before they can be matched.
• We may request proof of age at any time, and may suspend an account while we check.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at contact@puresouls.app if you suspect any unauthorised use of your account.

You may not create accounts using automated means, share your account with others, or impersonate any person or entity. We reserve the right to reclaim usernames that violate our guidelines.

Pure Souls provides a mobile platform where users can:

• Converse with AI-powered companion personas ("Pure Souls").
• Build a personal profile through natural conversation that helps the app understand who you are.
• Receive personalised conversation coaching and social-skills tips.
• Be introduced to other real users with whom you may share a genuine connection (the "Matching" feature).

We may update, modify, or discontinue parts of the Service at any time. Where changes are material, we will provide notice in advance.

Each "Pure Soul" persona is an AI-generated character. These personas are entirely fictional. They are not real people, do not have legal identities, and any resemblance to real individuals is coincidental.

You acknowledge that:

• AI companion responses are generated by machine learning models and may occasionally be inaccurate, inconsistent, or unexpected.
• The relationship you build with your companion exists within the app and does not constitute a real human relationship.
• We do not guarantee any particular response quality, conversation continuity, or persona consistency.
• We may update AI models underlying your companion, which may affect its personality or conversational style.

The Matching feature is optional. When enabled, Pure Souls may suggest other real users of the app who we believe you might genuinely connect with, based on compatibility signals derived from your conversations and profile.

You understand and agree that:

• Matching suggestions are algorithmically generated and we make no guarantees about compatibility or the outcome of any connection.
• Pure Souls is a platform for introductions only; we are not responsible for the conduct of users you meet through the app.
• You should exercise the same caution you would in any online social interaction: do not share sensitive personal information (such as home address or financial details) with people you have just met.
• You can disable the Matching feature at any time in your account settings.

Pure Souls introduces real people to one another, so these rules are a condition of access rather than guidance. They apply to everything you do on the Service: messages to AI companions, messages to other users, your public profile, your photos and other media, your display name, and any contact with our team.

Exploitation, abuse, and sexual harm

You must not use Pure Souls to commit, attempt, threaten, promote, solicit, arrange, normalise, or facilitate any of the following:

• Child Sexual Exploitation and Abuse (CSEA), including Child Sexual Abuse Material (CSAM). You must not create, upload, request, share, link to, describe, or seek out any material or conduct that sexually exploits or abuses a person under 18 — whether that person is real, fictional, animated, or AI-generated. This prohibition covers the sexualisation of minors in any form, grooming, sexual extortion of a minor, arranging or attempting to arrange sexual contact with a minor, and trading or advertising such material. There is no context in which this is permitted, including private messages, fiction, or roleplay with an AI companion.
• Human trafficking. You must not recruit, transport, transfer, harbour, advertise, solicit, or receive any person — by force, fraud, coercion, abduction, deception, or abuse of power or vulnerability — for the purpose of exploitation. This includes trafficking for sexual exploitation, forced labour, servitude, slavery or practices similar to slavery, forced marriage, and the removal of organs.
• Sex trafficking and commercial sexual exploitation. You must not advertise, solicit, arrange, coordinate, facilitate, or profit from commercial sexual activity, prostitution, or escort services, and you must not use the Service to recruit, advertise, or broker any person for them. This applies whether or not the person is said to be consenting and whether or not money changes hands on Pure Souls.
• Sexual violence. You must not threaten, incite, glorify, depict, describe, or plan rape, sexual assault, sexual coercion, or any other non-consensual sexual act, and you must not use the Service to pursue or carry one out.
• Non-consensual intimate imagery (NCII). You must not share, publish, threaten to share, or solicit intimate or sexually explicit images or recordings of any person that were made or are being distributed without that person’s consent. This includes so-called “revenge pornography”, covert or hidden recordings, synthetic or AI-generated intimate imagery of a real person (“deepfakes”), and sexual extortion of any kind — that is, threatening to publish such material to obtain money, further images, or any other benefit. Intimate content shared without the depicted person’s consent will be removed and the account terminated.
• Aiding, abetting, encouraging, or facilitating abuse or exploitation. You must not assist, enable, instruct, advise, fund, advertise for, recruit for, conspire in, or encourage any other person to do any of the above, or to commit any other form of abuse or exploitation — whether on Pure Souls or elsewhere, and whether or not the harm is ultimately carried out. Enabling harm is treated the same as committing it.

Profile content and sexual material

• Sexually explicit profile content is prohibited. Profile photos, profile text, display names, and any other content shown to other users must not contain nudity, sexually suggestive partial nudity, visible genitalia, depictions of sexual acts, or any other sexually explicit material.
• You must not send sexual content, including sexual images, to another user who has not asked for it.
• You must not use the Service to distribute, advertise, or link to pornography or adult services.
• You must not post or transmit content depicting or promoting bestiality, incest, or any other unlawful sexual conduct.

Scams, fraud, and financial harm

Pure Souls must not be used to defraud the people you meet on it. You must not:

• Operate or attempt any scam, confidence trick, or other scheme intended to defraud users — including romance scams, in which a person feigns affection, intimacy, or a relationship in order to obtain money or anything of value.
• Solicit money, gifts, cryptocurrency, gift cards, wire transfers, bank or card details, or other financial support from other users, whether by deception, by invented hardship, emergency, or travel costs, or otherwise.
• Promote investment, cryptocurrency, trading, or “get rich quick” opportunities to other users, including long-confidence investment frauds of the kind known as “pig butchering”.
• Phish for credentials or personal data, impersonate Pure Souls or our staff, or direct other users to fraudulent websites, apps, or payment pages.
• Blackmail or extort any person, or threaten to expose information in order to obtain money or any other benefit.

Harassment and harm to others

• Harass, threaten, stalk, bully, intimidate, or harm other users.
• Post or transmit content that is hateful, discriminatory, defamatory, or obscene, or that attacks a person or group on the basis of race, ethnicity, national origin, religion, disability, sex, gender identity, or sexual orientation.
• Threaten, incite, or glorify violence or terrorism.
• Encourage or promote suicide, self-harm, or disordered eating.
• Publish another person’s private or identifying information without their consent (“doxxing”).
• Impersonate another person or misrepresent your identity, age, or affiliation with any entity.
• Violate any applicable law or regulation, or use the Service to buy, sell, or arrange anything illegal, including controlled substances, weapons, or stolen goods.

Platform integrity

• Attempt to reverse-engineer, scrape, or extract data from the Service.
• Use automated scripts, bots, or crawlers to interact with the Service.
• Introduce malware, viruses, or other harmful code.
• Attempt to gain unauthorised access to any part of the Service or its infrastructure.
• Use the Service for commercial solicitation, advertising, or spam without our prior written consent.
• Attempt to manipulate an AI companion into producing content that violates these Terms, including by roleplay, hypotheticals, or other attempts to circumvent our safeguards.
• Evade a ban, suspension, or block — including by creating a new account.

Reporting and enforcement

Every profile, chat, and kin match carries a report control, and you can block any user from the same place. Reports of exploitation, sexual harm, or fraud are prioritised. You can also write to us directly at contact@puresouls.app; if someone is in immediate danger, contact your local emergency services first.

We may remove content, restrict features, and suspend or terminate accounts that breach these rules, with or without notice, and we may retain and disclose account data where necessary to investigate a breach, protect our users, or comply with the law. See our Law Enforcement Guidelines for how we handle official requests.

You retain ownership of content you create and share on Pure Souls, including the messages you send in conversations. By using the Service, you grant Pure Souls a worldwide, non-exclusive, royalty-free licence to use, store, process, and analyse your content solely to operate and improve the Service as described in our Privacy Policy.

You represent and warrant that you have all rights necessary to grant this licence and that your content does not violate any third-party rights or applicable law.

We do not claim ownership of your personal conversations.

All rights in the Pure Souls app, website, AI personas, brand assets, software, and content created by us are owned by Pure Souls or our licensors. Nothing in these Terms grants you any rights in Pure Souls' intellectual property except the limited right to use the Service as described herein.

"Pure Souls" and related marks and logos are trademarks of Pure Souls. You may not use them without our prior written permission.

Certain features of Pure Souls may require a paid subscription or in-app purchase. By subscribing or making a purchase, you agree to pay all applicable fees at the prices displayed at the time of purchase.

Billing

Subscriptions renew automatically at the end of each billing period unless you cancel before the renewal date. You can manage your subscription through your device's app store settings (Apple App Store or Google Play).

Refunds

Refunds are handled according to the policies of the app store through which you made your purchase. Pure Souls does not directly issue refunds for app store transactions. For direct purchases, contact us at contact@puresouls.app within 14 days.

Price changes

We reserve the right to change our pricing. We will notify you at least 30 days in advance of any price increases, and your continued subscription after the effective date constitutes acceptance.

We do not warrant the accuracy, completeness, or usefulness of any AI-generated content. AI companions may produce content that is incorrect or inappropriate — if you encounter such content, please report it to us.

Pure Souls is not a mental health service and is not a substitute for professional medical, psychological, or therapeutic support.

To the maximum extent permitted by applicable law, Pure Souls and its officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Service.

Our total liability to you for any claims arising under these Terms shall not exceed the greater of (a) the amount you paid to Pure Souls in the 12 months preceding the claim, or (b) USD $100.

Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability. In such jurisdictions, our liability is limited to the greatest extent permitted by law.

You may delete your account at any time through the app settings or by emailing contact@puresouls.app.

We may suspend or terminate your access to the Service immediately, without prior notice, if we believe you have violated these Terms, posed a risk to other users or to us, or if required by law. Upon termination, your right to use the Service ceases immediately.

Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will continue to apply.

These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts in the jurisdiction where Pure Souls is registered, unless otherwise required by applicable consumer protection law in your country of residence.

If you are a consumer in the European Union or United Kingdom, you also benefit from the mandatory protections of the laws of your country of residence.

We may revise these Terms from time to time. When we make material changes, we will notify you via email or an in-app notification at least 14 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.
